    The First Amendment isn’t at play on this case or decision. It was an easy call and should have been unanimous instead of just 8-3.

    1. Sure it does. A homosexual applies for the organist position at an evangelical church. The church believes that homosexuality is a sin and refuses to hire him/her.

      Who wins? The church’s right to the freedom of religion? Or the homosexual’s right to not be discriminated against?
