MEDFORD, Ore. — A Central Point, Ore., woman accused of fatally shooting her husband and attempting to flee had blood-alcohol levels nearly triple the legal limit when she was captured, and her lawyer says she was too drunk to remain silent.
The Mail Tribune reported 56-year-old Susan King’s lawyer argued in court documents filed in Jackson County Circuit Court that she was too intoxicated to waive her Miranda rights after the incident.
Court documents say King was pulled over Aug. 17, 2017, and arrested near her home on a drunken-driving charge and on suspicion of shooting 58-year-old Duane King.
King’s lawyer, Michael Bertholf, said in documents they want to exclude statements she made to police because of “extreme intoxication.”
King faces charges of murder and attempting to elude police in a vehicle, along with a count of driving under the influence of intoxicants.
